Spoke with the neighbour on whos behalf I posted this question. He found a nice tidy Laguna III in a dealer which had been imported from the UK. He said it looked ok and he drove it a short distance, liked it and paid a deposit. He sent in a certain motoring organsiation to give it a medical and the found quite a few things wrong. The worst seems to be a knock from the engine over 3000rpm and two leaking shocks. He claims the garage messed him around over when it was to be ready and the scale of the repairs. He subsequentlty cancelled the purchase and they've refused to return his deposit. Smalls claims court looms....

I was under the impression that deposits ( not just car sales ) you lose it if don't complete ?

Don't know if the deposit thing is part of law or just standard in small print.
Would think you might have a case if the seller has been arsing about though

Depends if the deposit was left subject to the Laguna passing the motoring organsiations checks on the vehicle whether a written or verbal contract. Also depends on below .................................................... If you bought a used car from a dealer the law under the Sale of Goods Act 1979 says that the car should be: of satisfactory quality fit for its intended purpose or a purpose that you made known to the dealer as described. If the car turns out to be faulty you may be able to get a refund a repair or ask for a replacement. Will try this below to the Dealer it might work. [Your address] [Company/ supplier address] Dear [Reference: contract number] On [date] I [bought/placed an order for] a [item], received it on [date]. I have discovered that the [item] has the following problem: [add details]. The Sale of Goods Act 1979 makes it an implied term of the contract that goods be as described, fit for purpose and of satisfactory quality. As you are in breach of contract I am rejecting the [item] and request that you refund the sum paid to you of [price]. I also require you to confirm whether you will arrange for the [item] to be collected or will reimburse me for the cost of returning it. If I do not receive your satisfactory proposals for settlement of my claim within seven days of the date of this letter, I intend to issue a claim against you in the county court without further reference to you. Yours faithfully, [Your name here]

Did anything become of this Will? He tells me he's gotten his solicitor to write to the garage and that's where it's at currentl Nobby. Other than that, no news I'm afriad.

Sorry if I come across as being nosey. Ah no, you're not being at all nosey - no harm in showing a healthy interest, is there. I don't know the full ins and outs of what really went on with the dealer but I reckon this neighbour could be a bit of a lightning conductor when it comes to attracting trouble. Heard of a spat he had with another dealer over his current motor and a tradesman over some work in the house. I think I'll give him a wide berth and get the SP from others who know him.
