A logical approach to this one (emissions failure) is whether it infringes any Construction & Use regulations? It certainly fails from an Homologation point of view, but if you are driving it outside of any LEV or ULEV zones, then you are not perpetrating any crime, surely?
The roads are filled with a variety of motor vehicles built to a variety of emissions specifications, but unless they are visibly emitting an indecent exhaust stream, nobody is any the wiser...

As I suspect there info would still show it as having an mot . They would if you had the VT30 on the passenger seat.

If you fail emissions on a spot check you have 10 days to rectify the issue, I can't find any info about an MOT fail?
